Guarantees

The assumption of a guarantee by https://yourvanstore.de/ requires an express declaration.

If the supplementary performance fails, the customer is entitled, at his choice, to demand withdrawal or reduction. Subsequent performance shall be deemed to have failed after the second unsuccessful attempt. The customer may only assert claims for damages under the following conditions due to the defect if the subsequent performance has failed. The right of the customer to assert further claims for damages under the following conditions remains unaffected.

Warranty claims expire one year after delivery of the goods unless https://yourvanstore.de/ is responsible for the defect. No warranty is given for damages resulting from improper or unsuitable use, faulty commissioning or assembly, natural wear and tear, negligent or faulty use, non-compliance with the maintenance or operating instructions and improper repair work or modifications by the customer or third parties.

The liability of https://yourvanstore.de/ is limited to the invoice value of the goods complained about.

The aforementioned limitations of the warranty do not apply if https://yourvanstore.de/ can be accused of malice or if it has given a guarantee for the quality of the goods.
As far as a customer on his part is exposed to warranty claims because of goods purchased from https://yourvanstore.de/, he is not entitled to the rights from § 478 BGB (German Civil Code), as far as a warranty is owed by https://yourvanstore.de/ according to the German Civil Code.
